Damage to State Sovereignty and Individual Liberty

For the last 100 years Progressives have grown the federal government in size and power causing damage to individual State sovereignty. Beginning in President Wilson’s administration and then swinging the doors wide open during President Franklin Delano Roosevelt’s (FDR) term. Today there is even a Progressive Caucus made up of congressmen in Washington.

On June 28th 2012 the Chief Justice of the Supreme Court cast the final vote for the Affordable Care Act. Chief Justice Roberts rewrote the argument from the Justice Department to make it work. Then John Roberts proclaimed the Patient Protection and Affordable Care Act (PPACA) constitutional as a tax. Roberts made new law instead of upholding the Constitution.

As of today it appears the House will not de-fund the PPACA from a Continuing Resolution (CR) while funding other portions of the government. This healthcare law will cause grave financial harm to Americans beginning in 2014.

There are many examples in the past of federal government overreach and power grabs, whether it is thousands of pages for a new law or thousands of laws that have been passed over the years. With thousands of regulations that have been written by a massive federal bureaucracy, that no one knows if they have ever violated them; many with stiff penalties and prison time.

For decades politicians have been elected and only small successes have been realized, but then only to fall by the wayside the next go-around of elections. Still the federal government grew in size and reach while both political parties had a hand in its growth.

When the current President, Barrack Obama took office back in 2008 and again in 2012 it was with a promise of change, and he meant it. In 2010 and 2012 common everyday Americans were feed up with the federal government and sent a new cadre of constitutional based conservatives to the House and Senate, only to learn a number of them caved to the career political elite.

The founders of this nation never intended for a federal government to have so much power, the powers granted were limited via enumeration in the Constitution. In fact the founders were very skeptical of having a federal government since they had so much trouble with the King of England interfering in every aspect of their lives.

A new course is spreading today, a bold new venture to halt the federal government from its reach and power it should have never had, to rein in a soft tyranny from massive regulation and laws. As it stands today the States are beholding to the federal government’s whim and it appears the Supreme Court can rule in unconstitutional ways when one least expects it.

It seems that America needs two fronts to stop federal overreach, the continuation of electing solid constitutionally based politicians. And by empowering the states to take the power back from the federal government where it rightly and constitutionally belongs; with the states and the people who reside within them.

A nationally known radio talk show host known as Mark Levin has written a book entitled, “The Liberty Amendments: Restoring the American Republic”.  Mark Levin served in the Reagan Administration under Attorney General Edwin Meese III. He is also President of Landmark Legal Foundation; no ordinary radio host. The purpose of Mark’s book is to start the conversation which can lead to action for the states to come together and make and pass constitutional amendments.

As an American and citizen of this great nation, I have started my action yesterday on August 22, 2013 by sending an email to two Governors, one Lt. Governor, two state House Speakers and one State Representative.

The Email:

Subject: Assembling a Convention of the States for U.S. Constitutional change

Esteemed Governors, Lt. Governor and Legislators

I’m asking for the sake of our nation’s survival, for you to consider within your legislatures, working with other state legislatures to form a Convention of the States. A convention for the sole purpose of offering up amendments to the U.S. Constitution that could rail back the federal government’s bloated power structure to within the limits of the Constitution. Article V gives the states the authority without congress to offer up Amendments and vote them up or down. It would take 2/3 of the States to call a convention with 3/4 of the States required for passage to become law.

Granted, this would be a long and arduous process to add to or change the existing U.S. Constitution, however we must begin somewhere or in my estimation, all is lost.

Article V: The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress; provided that no amendment which may be made prior to the year one thousand eight hundred and eight shall in any manner affect the first and fourth clauses in the ninth section of the first article; and that no state, without its consent, shall be deprived of its equal suffrage in the Senate.

I would recommend a primer for you to read, written by Mark Levin, who served in the Reagan Administration under Attorney General Edwin Meese III. In his book he outlines various proposed Amendments.

The Liberty Amendments: Restoring the American Republic

In Liberty,

You may think you are totally free, but we have become accustomed (nudged) to overbearing laws and burdensome regulations which only leads to an inevitable end; absolute tyranny.

The Heat for Congressional Term Limits

There has been a push since our founding to require congressional term limits. Due to the log jam in congress and their deafness when it comes to listening to the people (rulers) for decades, the heat is back on high for term limits.

Benjamin Franklin on term limits: Sir, there are two passions which have a powerful influence on the affairs of men. These are ambition and avarice; the love of power and the love of money. (From Mark Levin’s book: The Liberty Amendments: Restoring The American Republic)

Franklin and others were very concerned about not adding term limits to the constitution for congress. That given time it would consist of men bent on power and money that would hold an office in congress for as long as they could. That even with their low pay, they would soon remedy that situation.

Mark Levin served in the Reagan Administration under Attorney General Edwin Meese III. He is President of Landmark Legal Foundation. He has his own proposal for Congressional Term Limits. Levin indicated that his proposals are just that, his proposals. However, it does start the conversation.

Section 1: No person may serve more than twelve years as a member of Congress, whether such service is exclusively in the House or the Senate or combined in both Houses.

Section 2: Upon ratification of this Article, any incumbent member of Congress whose term exceeds the twelve-year limit shall complete the current term, but thereafter shall be ineligible for further service as a member of Congress.

Levin’s proposals for congressional term limits seem to be a good basis for further discussion. Twelve years total appears to be a good number. However, maybe a shorter period would be better, possibly six years total.

Some good points concerning term limits for congress would be that they would be less likely to lay unpopular laws on the American people. Congress may be less likely to spend money on pork projects that would help them to be re-elected while working towards shrinking the federal government. In fact they may even do the peoples Will for once, instead of bending to lobbyist groups.

It may be the key to turning our nation around while getting the government off our backs and destroy that “career country club” of members helping other members in the election cycle after election cycle.

The Radical Left Recognizes Your Needs

One of the greatest tools that the Left knows about you is your “Needs”. The Radical Left most likely teaches this concept to its people as they engage in propaganda of how they know best to supply those needs. There are many people who do not understand that the Left cannot supply all of your needs.

Abraham Maslow had a theory on how we as humans meet our needs and he classified them in order from bottom to top in a pyramid fashion.

As you can see from the chart as we meet the bottom needs we climb up the pyramid to satisfy higher need(s). Even climbing up the pyramid we have to revisit a lower need, such as food. Because without satisfying a lower need we cannot climb to or stay with a higher need.

The Marxist (the Left) experts are very aware how to appeal to our needs as the ones who can supply them. Those in the federal government and those who advise them have been bombarding Americans with their help, such as an expansive 99 weeks of unemployment checks (we care) or by forcing businesses to lay off its employees thereby causing a massive increase in food stamp recipients. This strategy of causing unemployment is played out by applying pressure on businesses with massive regulation compliance and programs such as Obamacare, causing you to rely on government help. Basically, they are forcing you into accepting their assistance for a “Physiological Need” (Food Stamps/Welfare) and in some cases even “Safety Needs” (government section 8 housing).

What the government cannot do is meet all of your needs. These needs are built-in to each of us and this is why forced government systems such as Socialism and Communism ultimately collapse as a replacement for Capitalism with widespread poverty. This is also why those countries that subscribe to Socialism or Communism have never matched the United States in power and wealth. However, the United States has fallen quite a bit down the ladder of wealth and personal freedoms due to the federal government overreach of power and expansive social programs.

The government has no business meddling with the economy on such a wide scale, either through high taxation, massive regulation or expansive welfare programs. The Left has control of the federal government, as many know. All you have to do is look around at the destruction of the economy and the increase of people on the government dole; all done on purpose. Those in the government live a far better life financially than most Americans do today; meeting their “higher needs”.

By understanding how you “tick” on the level of “Needs” you can combat the Left and ferret out their propaganda machine. You will realize why they are destroying the economy bit by bit in order to force a remake of our system of government from a republic to possibly a tyrannical form where you “depend on them for your needs”.

A society with limited government involvement in their lives will afford them the greatest opportunity to meet all of their needs by freeing Americans to climb that “natural human ladder” to success and fulfillment.

Maslow’s Hierarchy of Needs: Class is in session

The Alamo of Constitutional Defense

Just as those brave Americans at the Alamo held the front line of defense against Antonio López de Santa Anna’s  forces, so too do those who speak out against an unconstitutional government today. Those Constitutional based Americans that the Left has excoriated on a daily basis and targeted in campaigns, such as the IRS to silence them.

The Alamo was defended mostly by patriotic and brave Americans who did not live in Texas. They came as patriotic brothers in arms to buy time for General Houston’s forces, to ready themselves to take on the massive army of Santa Anna. This time it’s not the Alamo or Texas at risk it’s the entire nation.

Those that man the Alamo today speak freely through online media while the American people read it and pass along what they have read to others. This “Alamo approach” of truth has been going on since the 2008 election by the Tea Party. The onslaught of Obama’s liberal forces continues to lie in the media and continue their direct attacks on individuals and organizations to this day.

Americans are being hit from all directions in all 50 states by the liberal forces that support a tyrannical controlling government. Americans are pounded with propaganda from the main stream media daily. Liberals are burrowed in every aspect of local, state and of course, the federal level. Whether it’s through race baiting, gender identity, the educational system, state legislatures and congress, the onslaught against your personal liberty continues; daily.

The government is killing off small businesses through onerous stiff regulations and on carbon based and fossil fuel energy producing companies which culminates a multifaceted approach to destroy America and increase unemployment. Where do the unemployed people turn to? The government is where they have to turn for help and that’s just part of their dark plan.

The entire goal of the Left which consists of Progressives, Liberals, Socialists, and Communists is to offer you a better life, when in reality what they offer you is lifelong bondage to a government ruled by tyrants, bent on controlling your life from cradle to grave; while they live comfortably. These tyrants are people who get their fix on controlling other people which feeds into their ideological egos; plain and simple. History is littered by the cruelty and destruction left by the wake of tyrannical governments of days gone by.

Here today and somewhere else out there is yet another volley from the “Alamo of American Patriots” and these brave citizens await more Americans to come to their aid in an open free vocal debate to save our liberty through truth. The battle continues.

United We Stand – Divided We Will Fall

Though there are varying opinions on “What, Where How and When” about America’s dilemma on liberty we have to…like the Beatles song touts…”come together right now, over me” (Let’s call “me” America…shall we?): Must get us old folk in the right mood.

Conservatives of all strips must come together and stop sweating the “small stuff” while in some circles many call it the “big stuff”. However, it is good to have polite debate on varying levels of disagreement. But, make no mistake the more we are divided the weaker, as a whole, we become when it comes to winning our country back. Lefty loves it and for sure will “stir the pot”. Lefty will keep the division going as much as possible and so will progressive republicans.

At the end of the day “we have to come together” as one, our liberty depends on it! No more “it’s not my guy and I will not give a penny or vote for him or her” and the non-conservative wins!

The 2014 election season is just around the corner and new and incumbent candidates will be popping up all across this great landscape.  It is time now to start watching and listening for those that don’t fall into the “progressive category” of big government. Remember, many republicans have fallen into the progressive line-up of potentials and it is those so-called conservatives that must be exposed and avoided.

Mr. Karl Rove and his gang of progressives are busy as bees collecting information from voters to plant in the platforms of so-called conservative candidates they will be funding in 2014. With beautiful “song” for the conservative ear to listen to and fall in love to a trap; beware.

In the 2012 recall election effort of Governor Scott Walker, the Republican National Committee (RNC) and a column by Karl Rove in the Wall Street Journal believed it was the RNC that saved Walker from losing his seat. However, it was the Tea Party Patriots of Wisconsin that pulled this save off. (It’s the Tea Party Brainless!).

Put the differences aside and concentrate your efforts working towards a more limited government. Then after conservatives have it all, at least at the federal level, we can work towards the problems that face us as a nation.

The Political Paradigm is Shifting

As always we hope our government will do the right thing; we depend on it. The democrats are doing “their” right thing for the party of big government with lavish tax and spend patterns, but the republicans seem to crumble when it comes to sticking to conservative common core principles. Only a handful of republicans have drawn a line in the sand over the years, sticking to their conservative values and principles of a smaller limited government.

Why do the majority of republicans think the democrats have them over a “barrel” and cave into pressure? Could it be it’s because the democrats are all about taking from the mouth of one and giving to the other?  The democrats in Washington are all about re-distributing taxpayer money and this is the corner-stone of their platform which garners (buys) them votes. Something is about to be given away to the people and republicans erroneously believe they must go along to stay in power.

Because of what the republicans have done to themselves Romney lost in the 2012 presidential election.  Their disillusioned electorate stayed home and didn’t vote. The people who normally vote for republicans are tired of weak and spineless lawmakers that continue to fail them.

Presently the House is wrangling with the “Border Security, Economic Opportunity, and Immigration Modernization Act” (S.744) from the Senate, the House republicans are crumbling while listening and reading from one-sided media outlets. Toss in Progressive (big government) republican consultants along with lobbyists and one can see why the weak ones jump on-board.  Big business with bags of money that could end up in re-election coffers “if only…if only you would just… hint”.

Something has happened and the political paradigm started its shift in 2010 after the current President proceeded to tear the country apart with massive destructive policies after he was elected in 2008. His big government reckless spending policies along with a complicit congress in his corner have put America in the poor house.  The American people responded back in 2010 with a large seat win in the House, making the republicans the majority; largest one time increase in 70 years. Not because the electorate loves republicans, but because the massive bleeding has to be stopped.

During the next election cycle of 2012 the republicans maintained their majority in the House. Again not a love fest for republicans from the electorate but the ship is sinking and the American people needed damage control. However, the republicans will still cave on some issues, worrying about their image; what image?

The political paradigm is shifting and is attributed to a more engaged electorate, something that has been missing for decades. No longer can the people vote and go back to work without worrying what is scurrying behind their backs. The old model of getting information through liberal media channels of radio and television has been usurped by obtaining information via internet sources. Politicians that lie to the electorate and then do the opposite are now suffering the consequences of their actions by being caught.

The political paradigm is shifting and congress has been put on notice.

Public Access to Congressional Research Reports HR 110

This little known bill that the public may not be widely aware of is one by Representative Leonard Lance of NJ. Back in March of 2013 he reintroduced H.R. 110 (Congressional Research Service Electronic Accessibility Resolution of 2013) and it is to mandate the Clerk of the House to:

…establish and maintain a centralized, searchable, bulk downloadable, electronic database consisting of: (1) CRS Issue Briefs, Reports, Authorization of Appropriations Products and Appropriations Products, and other materials intended or available for general congressional distribution through the CRS website; and (2) an index of such information

…Directs the Clerk, in addition to the database, to establish and maintain contemporaneously a website containing a searchable, sortable index of all of the information in the database in both human and machine-readable formats (such as Extensible Markup Language [XML]).

Presently the Congressional Research Service consists of 700 employees that search the library of congress for information that is of interest and related to pending or proposed legislation, these researchers:

including lawyers, economists, reference librarians, and social, natural, and physical scientists, are governed by requirements for accuracy, objectivity, balance, and nonpartisanship

…The Congressional Research Service has a responsibility to ensure that Members of Congress have available the best possible information and analysis on which to base the policy decisions the American people have elected them to make.

This research information is to be made available via a centralized CRS website for the public in a “one stop” fashion and would be a leap forward in public access to the same information that Congress gets.

If H.R. 110 comes to fruition it will save the public a great deal of time doing research through many periodicals in the library of congress or through other sources. The public will have available to them the best information researched for their use:

…Allowing public access to CRS will empower citizens and enable Members of Congress to become even more effective “representatives” of the public’s concerns and goals.

One may think this is not an idea you can sink your teeth into, but just think what you can do when an issue comes up and you engage your representative beyond a previous limited knowledge of the subject. You may find that from what you can obtain from public access to a CRS data base will dwarf other sources, especially when you throw your support for or against a proposed piece of legislation.

This bill currently has 8 co-sponsors with 6 Democrats and 2 Republicans. It will be interesting if this bill makes it out of committee and if it does, will it make it to the floor and will it pass?

NSA Monitoring of Americans not Constitutional (Case Law)

What we were told when the Patriot Act was put in place by congress that only phone calls or emails from overseas to state side would be looked into; looking for terrorist connections. Apparently this has not been the case. There are even those in congress that are supposedly conservative, such as Michele Bachmann defending the practice of monitoring everything Americans do using electronic devices.

The monitoring by NSA has another effect besides reading and capturing phone calls. A number of years ago the FCC wanted to clamp down on the Internet under the guise of making sure everyone had equal access. It turns out that this would have clamped down on free speech and eventually was turned back. With what has been found out about the NSA’s widespread eves dropping, it must have an effect on those that would normally make use of electronic means to make phone calls, to read or write about our government. Snowden’s revelations about the NSA snooping and gathering activities for storage must send a chill through all Americans to curtail their activities.

The right of the people to be secure in their persons,

houses, papers, and effects, against unreasonable searches and

seizures, shall not be violated; and no Warrants shall issue but

upon probable cause, supported by Oath or affirmation, and

particularly describing the place to be searched, and the persons

or things to be seized.

Previous court cases have indicated that electronic gathering of private activities of individuals cannot be monitored or gathered without a warrant.

Olmstead v. United States, {32} one of the two premises

underlying the holding that wiretapping was not covered by the

Amendment was that there had been no actual physical invasion

of the defendant’s premises; where there had been an invasion, a

technical trespass, electronic surveillance was deemed subject

to Fourth Amendment restrictions.

{33} The Court later rejected this approach,

however. ‘‘The premise that property interests control the

right of the Government to search and seize has been discredited.

. . . We have recognized that the principal object of the Fourth

Amendment is the protection of privacy rather than property, and

have increasingly discarded fictional and procedural barriers rested

on property concepts.’’

{34} Thus, because the Amendment ‘‘protects

people, not places,’’ the requirement of actual physical trespass is

dispensed with and electronic surveillance was made subject to the

Amendment’s requirements.

This revelation about the NSA and what the agency has been doing can be argued that its search and seizure methods of electronic information on a wide scale are without warrant and violate 4th Amendment protection.

Department of Homeland Security is unnecessary

If there is one department within the federal government that should be axed, it’s the Department of Homeland Security (DHS). Many other departments have been targeted by Americans for deletion from the national landscape, but it seems that Homeland Security gets a pass. With 240,000 strong within the department, one may ask what are they building. The 2014 budget for DHS is projected at $59,959,337,000. DHS is in every state and stationed in over 75 countries. Does the CIA need help in doing its job abroad? If the CIA needed more help why not add more personnel and agents? Why is DHS in every state, how come the FBI can’t do the job of homeland security; after all it’s their job. Are the CIA and the FBI so inept they need help?

DHS Budget history

We were viciously attacked on September 11, 2001 and America was rocked back on its heels. However, did this mean the FBI and the CIA failed in their jobs? Apparently so, because the answer Washington came back with was to expand the federal government even more with the establishment of DHS. Just because we took a tremendous hit that shocked America does not mean we needed another department.

There are plenty of assets within our government that has proven itself time and time again against domestic threats. The FBI has always been the domestic stop gap and the CIA has worked the overseas connection. Just because we took a big hit in 2001, should we have built yet another bloated bureaucracy? Couple the DHS with NSA that tracks and records your voice phone calls, GPS movements, emails, and text messages, it begs the question, why so much personal information on you and why is it being stored?

There is another election coming our way in November of 2014. The American people would do well in keeping the House majority Republican and taking over the Senate with a Republican majority. But not with weak kneed Republicans but with principled conservatives that don’t serve in name only.

It’s long overdue to stop this “monster” which puts in-place a dangerous tool and if placed in the wrong hands can usher in an overnight police state.
